Website Care & Hosting Agreement

Optional Website Care and Hosting services for Walk-In Websites clients. Services, responsibilities, backups, support and governing terms.

Governing law
This Agreement is governed by the laws of Queensland, Australia.

Purpose

This Agreement governs the optional Website Care and Hosting services provided by Walk-In Websites. It applies in addition to the Website Design & Digital Services Agreement.

Services

Depending on the selected Website Care plan, services may include website hosting coordination, software updates, security monitoring, minor content updates, technical support, uptime monitoring, backup management and restoration assistance.

What's Included

Only the services listed in the Client's selected plan are included. Requests outside the plan, including redesigns, new functionality, copywriting, SEO campaigns, branding or major development work, will be quoted separately.

Hosting

The Client may choose to host their website with Walk-In Websites or another provider. If the Client transfers to another provider, Walk-In Websites will provide a reasonable website handover once all outstanding invoices have been paid.

Ownership

The Client owns the completed website, domain name and content after payment in full. Walk-In Websites retains ownership of its proprietary systems, templates, reusable code, workflows and intellectual property.

Website Care

Website Care is provided on a best endeavours basis. We aim to keep websites updated and secure but cannot guarantee uninterrupted availability or protection from every cyber threat, software defect or third-party outage.

Backups

Where backups form part of the selected plan, Walk-In Websites will maintain periodic backups. Clients are encouraged to keep independent backups of critical business information.

Support

Support is available during normal Australian business hours unless otherwise agreed. Response times are targets only and are not guaranteed.

Client Responsibilities

The Client must maintain valid licences for third-party software, promptly review requested changes, protect passwords and notify Walk-In Websites of suspected security incidents.

Third-Party Providers

Services rely on third-party providers including hosting companies, domain registrars, Cloudflare, Vercel, Stripe, Google and other software vendors. Walk-In Websites is not responsible for outages, failures, pricing changes or service interruptions caused by third parties.

Limitation of Liability

To the maximum extent permitted by law, Walk-In Websites excludes liability for indirect, incidental and consequential loss, including loss of profits, revenue, goodwill, data, business interruption or opportunity. Liability is limited to the fees paid for the relevant Website Care services, subject to any rights that cannot be excluded under Australian Consumer Law.

Suspension and Termination

Website Care services may be suspended for non-payment. Either party may terminate ongoing Website Care by providing reasonable written notice. Outstanding fees remain payable.

Changes

Walk-In Websites may amend Website Care plans, pricing or inclusions by providing reasonable notice. Existing contractual rights will continue for the current billing period unless otherwise agreed.

Nothing in this Agreement limits any rights you may have under applicable Australian laws, including the Australian Consumer Law. This Agreement should be read together with our Privacy Policy, Refund Policy and any other legal notices published on our website.
